Criminal Background Search Obligations
As of October 1, 1997, the Fair Credit Reporting Act (FCRA) requires that
all employers who pre-screen applicants and conduct criminal background
searches must have prior written consent from the applicant. In addition,
some jurisdictions do not allow third-party requesters to provide arrest
information, unless a conviction was entered. Lastly, if the applicant is
not chosen for the position applied for based on information obtained through
the background screening process, the applicant has the right to see the
